Basically, conference is primarily concerned with creating meaning from the messages passed from the sender to pass receiver and this is possible if the parties involved are willing to listen to each other. It is suggested that listening to feedback from others helps us to understand what is being said and correct any misunderstanding that may arise (Burley-Allen , 169).In interpersonal communication, deception is very common. feigning can vary from blatant lies to indirect actions su ch as exaggerations and false implications (Hopper & Bell, 1984 as cited in Stewart, Zediker. & Witteborn, ND, p. 330). Bernard Madoff Ponzi Scheme Case Essay Example | Topics and Well Written Essays - 1500 words

Bernard Madoff Ponzi Scheme Case - Essay ExampleThe fraud caused investors to lose billions of dollars, and gave rise to a crisis of confidence in the capital markets. In reality, Madoffs currency had no investment strategy to provide hedges against the usual forms of risk. For everywhere a decade, there had not even been any trading of stock. In Madoffs Ponzi scheme, the archaeozoic investors were bought off with the money from the later investors addition wholey, the payouts to the early investors were used as proof of profitability, to thereby convince later investors that the returns were legitimate. The bankruptcy trustee is implementing remedial measures including a clawback sue for the later investors to recover the profits of the early investors. Thesis Statement The purpose of this paper is to investigate the Bernard Madoff Ponzi Scheme Case, examine the reasons for the fraud to take place over several years, identify the warning red flags overtoped by the investors, an d the preventive and recovery measures to be adopted in Ponzi cases, besides other related aspects. Bernard Madoffs Ponzi Investment Scheme The investment operation of Bernard Madoff was exposed in December 2008 as an extensive Ponzi scheme. The term is derived from Charles Ponzi who organized such a scam in 1919, and it denotes a fraudulent investment arrangement in which investors give cash and property to the of import individual in the arrangement. While misappropriating some or all of the funds, the investment operator reports to the investors that the funds made profits. These professed amounts, and those actually paid to earlier investors are funds received from later investors. The fraud is revealed usually when a intumescent number of investors wish to withdraw their investments at the same era, particularly when there is insufficient in-flow of money from new investors. Thus, Bernard Madoff duped investors of an estimated amount of more than $50 billion, by the time the fraudulent scheme was uncovered (Mannino, 2010). Madoffs alleged Ponzi had a reach across the globe of more than $50 billion. The sustained durability of the fraud for or so two decades is considered to be due to Jewish money managers, severe regulatory shortcomings including ineptitude, and probable conflicts of interest by Federal Communications agency (FCC), Securities and Exchange Commission (SEC), and other regulators and auditors. Madoff appears to have taken actions that reveal him as an equal opportunity thief, who unashamedly misappropriated funds from close relatives and charities in his scheme (Vinod, 2009). One of the main reasons for Madoffs attracting a wide following was that he delivered consistently high returns with very low volatility over a long period (Bernard & Boyle, 2009, p.3). His proficiency to obtain these low risk returns was to use a split-strike conversion strategy. This requires taking a long position in equities together with a short call, and a lo ng put on equity index to lower the volatility of the position. It was eventually revealed that these returns were false. The Madoff case raises obvious questions on why it was not discovered earlier, and the reasons for investors and regulators to miss the various red flags. The need for risk management and regulation through improved capital requirements for operational risk, is evident from the implications of

Prison life and strategies to decrease recidivism upon an inmates Essay

Prison life and strategies to decrease recidivism upon an inmates release from prison - Essay ExampleIn the US, the rate of recidivism is estimated to be approximately two-thirds of all released inmates (Andrews & Bonta, 1994). This means that at least two-thirds of prisoners released will ultimately be re-imprisoned within a period of three years. highschool recidivism rates impose immense costs with regard to public safety, as well as tax dollars utilized in arresting, prosecuting and imprisoning re-offenders. Due to these high costs, programs for inmates, as well as released prisoners, which reduce recidivism, can prove cost effective, even in the event of modest success (Perkinson, 2010). This paper will consider the US prison system, describing its aspects such as prison life, the existence and effectiveness of programs that reduce recidivism and programs aimed at reintroducing released prisoners into nightspot. Purpose for Prisons in the US As an institution, the prison plays a overcritical role in the society. The US justice system bestows on prisons various roles. The first essential role is rehabilitation prisons provide convicts with second chances to appreciate and visualize from their misconducts and change. In essence, prisons help inmates reflect on their lives and search for ways through which they can coexist peacefully within the society. In addition, prisons offer inmates with learning environments in which they acquire new skills essential in enabling them earn decent livelihoods after their release (Armitage, 2002). Another critical role of prisons is deterrence and punishment aimed at discouraging inmates and others within the society from committing similar crimes. Forms of punishment vary contingent on the crimes committed, ranging from hard labor to the death penalty. Such punishment deters others in the society from committing crimes, thus ensuring peace and harmony within the society (Andrews & Bonta, 1994). Moreover, prisons provi de justice to victims of crimes. Because law centers on justice and equity, victims of crimes receive justice through the immurement of those that harmed them. The incarceration of a wrongdoer provides closure to the victim of the crime. Lastly, prisons in the US protect the public from threats to security and safety as incarceration deters criminals such as serial publication killers and rapists from committing crimes within the society. Current conditions in US prisons The present condition of US prisons is less than ideal. Prisoners presently live in deplorable conditions characterized by extreme overcrowding. The item in US prisons provides a viable environment for crime to thrive within prison boundaries. Perkinson (2010) poises that the California and Texas prisons, which are the biggest in the US, have, in the last 30 years, experienced an eight fold increase in the number of prisoners incarcerated. Despite the growing number of inmates, funding for prisons has barely incr eased, making it onerous to meet the postulate of prisoners (Armitage, 2002). Inadequate funding makes it difficult for prisons to teach prisoners effective skills to enhance their re-introduction into society. Although the US encompasses 5% of the global population, its prisons encompass 25% of the global prisoner population this indicates the exorbitance of the issue. Increased congestion in US prisons is also attributable to increased levels of crime and recidivism in the US. This congestion diminishes the rehabilitative role of prisons as congestion makes it difficult

The term radio receiver network a good deal refers to a Wi-Fi or 802.11 networking, from the protocols that control the wireless network concept (Kumar, Manjunath & Kuri 2). Wireless networks are consistently proving their worth in todays world, with coverage of grievous services like FM radio, AM radio, satellite television, broadcast television, and satellite internet, which all form a basic part of our lives. The history of wireless networking stripping takes us back to 1888 when Heinrich Herz discovered the first radio wave. In the years that followed, other scholars w ere further developing the radio frequency concept. Marconi was the first known soldiery to successfully transmit and receive a message using radio waves in a distance of two miles, labeling him the father of radio.... The resultant heartbeat generation WLAN was upgraded and was four times faster, with an operational speed of 2Mbps. Further developments led t the design on the third generation WLAN, which are in use currently (Kumar, Manjunath & Kuri 23). The Institute of Electrical and Electronic Engineers (IEEE) 802 committee in 1990 set up the 820.11 Working Group that would be the foundation of the WLAN stock. Among the specifications of the standard was an operating frequency of 2.4GHz ISM band, and consequently approved the IEEE 802.11 to be the first WLAN standard with frequency of between 1and 2 Mbps. Building a wireless network will require an access point, which receives and sends radio signals, as well as acting like a repeater. Another vital device needed in all the devices in the wireless network is the wireless network card. A desktop computer usually has an internal card, and may or may not have antennas. Notebooks have a PCMCIA extension slots for the card, if not installed from the manufacturer. There are two basic forms of configuration for a wireless network stem and Ad-Hoc. An infrastructure wireless configuration constitutes more than one access point connections to an already existing single wireless network. This will enhance the sharing of p generator among the devices in the network, like the internet and printers. Here, a computer acts like a hub that provides connectivity for the other computers in the network, hence connecting a wireless LAN to a wireless LAN (Kumar, Manjunath & Kuri 54). On the other hand, an Ad-Hoc wireless network configuration connects one device directly to another device on the network, hence the common reference to peer-to-peer network. All devices can connect directly to each other, but there must be o ne that is

The procedure of making a simple metallic bucket may vary from one manufacturer to another but largely it involves four stages namely (1) Measurement and Marking stage (2) Cutting stage (3) Folding stage, and (4) Joining Stage. In the MEASUREMENT stage, the correct sizes of the parts that make up the bucket i. e. the bottom part, the curved part that forms the body of a bucket, and the handle are measured and marked on metallic sheets. A metallic bar tape, inside and outside calipers, and marking knife will be most appropriate tools used in this stage. The measured and marked parts are because carefully CUT using either a cold chisel or metal-work scissors depending on the density of the metal sheet. The next stage involves folding of the cut pieces in order to prepare them for the final stage. Pliers, anvil, measuring tape, and metal-work hammer are the most appropriate tools in this stage. The folded metal pieces are then join together using the most appropriate joint i. e. that is simple and can hold on for along time, double seamed joint may be preferred than riveted joint. The handle is also fixed at this stage a curved handle may be used because it tends to re sist breaking earlier than that with edges. Contract Laws Essay Example for Free

Contract Laws EssayWhen it comes the righteousnesss of business thither ar a broad range of categories and topics. A topic that we would find when studying business law is urges. A hire is a leg anyy enforceable stipulation between dickens or more people. (Rogers, 2012) In the world we live in development about entreat laws is very vital when memorializeing into one. We must be aw be that there is more than just on grapheme of abridge and there are several steps that both parties must follow before any buzz off can be wakeless. There are several types of reads that various(prenominal)s can enter. These types are expressed, implied, zygomorphous, unilateral, simple, formal and quasi contracts. An express contract are formed by the express language of the partiesthe actual words they use in their transcriptionand can be either written or oral. (Rogers, 2012) This type of contract does non call for to be in writing. An expressed contract contains the offer, ado ption and contemplation elements of a contract. Express contracts are usually compared to implied contracts. Implied contacts are formed not by the express words of the parties, exactly rather by their actions. (Rogers, 2012) With this type of contract the accordance is implied by actions. There are no expressed words within an implied contract. It can be either implied in fact or in law. If a contract will result in inequity or harm it will not be implied. If there is any doubt or discrepancy exists, then the court might not conclude a contractual consanguinity. If an implication arises that they have jointly combineed to a new contract that contains the analogous requirements as the old agreement. An different type of contract is a bilateral contract. A bilateral contract is a reciprocal arrangement between two parties to a lower place which both parties promise to perform an act in exchange forthe new(prenominal) callers act ( crinkleDictionary.com). When entering into a bilateral contract there is a joint agreement among the two parties that entails the performance of an act. The promise do by one companionship constitutes sufficient consideration for the promise made by the other party. It is a common contract because we enter into a bilateral contract everything we make a purchase, order or receive any kind of treatment. reversible contracts are compared to unilateral contract. Unilateral contract are agreements that deal with a promise that is made by only one person involved in the contract. This agreement is when there is an exchange for the performance or non-performance of an act by the other party. Only one of the contracting parties can be enforced to abide by with contract. This type of contract is one-sided because only the offeror is efficaciously bound in complying with the terms of the contract. The offeree can comply or refrain from performing the act, only he or she cannot be sued if they do not comply. If you accept an offer f rom a unilateral contract it cannot be achieved by making another agreement only by performance or non-performance of some particular act. An offer can be revoked until the act has been performed or there was no act accurate and the date has passed. The following contract is called a simple contract. It is in no way a lawfully recorded or legitimately sealed contract, merely breeches are still frequently ruled on by a judge. It is any oral or written contract that is not needed to follow a specific form, or be signed, witnessed, or sealed. (Rogers, 2012).They are not necessarily formalized contracts and do not entail court transactions in order to make them binding. They are simply an agreement that is among the parties involved. They are usually compared to formal contracts. Formal contract are a written agreement between two parties that are considered to be legally binding and enforced my law (Laws.com). They must be in writing, signed and seal by all parties entering into th e contract. In order for a formal contract to be valid it must contain three elements, which are the offer, the acceptance and a earnings for the services provided or goods delivered. This type of contract eliminates any uncertainty regarding its terms and conditions. It contains a preface section which is utilized to clearly define the essentials terms that are utilized within the contract. This helps in eliminating redundancy in the use of common language. It also insures substantive terms of the contractthat are described and referenced in the contract.Quasi contracts are the last type of contract discussed in the text. Quasi contracts are not a realistic contract. They are a remedy that a court may offer to make things fair. (Rogers, 2012). This type of contract is implied by law. Courts will imply a fictional contract to require one party to flow benefits to the other party where unjust enrichment has occurred. Unjust enrichment doctrine deals with the equality of a quasi co ntract. It states that no party should profit at the expense of the other without making restitution of a reasonable value. When there is no oral or written agreement, courts depend on this doctrine to provide a legal remedy for a quasi contract.A Quasi contract can be compared to an implied contract. There are two types of implied contracts. These types are Implied-in-fact and Implied-by-law. A quasi contract is considered to be an Implied-by-law. It is different from an implied-in-fact because the courts treat the former as an express written contract because of the actions and words that both parties have expressed. Even though neither party has verbally expressed the acceptance of the contract their actions might be viewed differently.A contracted can be valid and enforceable, but can also be found to be unenforceable and can be voided. In order for a contract to be valid and enforceable it must contain the quintette elements of a contract to be legally binding. These elements are offer, acceptance, consideration, legality and capacity. The first element of a valid contract is the offer. An offer is an invitation for another to enter into a contract (Rogers, 2012). Offers can be verbal or written, but must at all time be clear terms. They can be bilateral or unilateral terms. They are not legally binding. Offers can be voided is any of the individuals involved cannot or do not comply with their promise. Offers can also be voided, repealed or annulled after parties have accepted the offer, unless there is a clause where it states that revocations are not allowed. The following element is acceptance. An acceptance is an acquiescence to enter into a contract under the terms of the offer (Rogers, 2012). Once an offer is made the parties must agree on the terms. All parties must be uncoerced to enter into the agreement. Acceptances can be implied orexpressed. They can be directed to all parties involved or just one person. There are times when the individual making the offer will invite the person accepting the offer by actually performing the acts that the offeror is bargaining for. This occurs when limited tribulations of notification, revoking and self-assertion in the form of limited performance can occur.Consideration is the next element of a valid contract. A consideration is anything of legal value that is asked for and accredited as the price for entering into a contract (Rogers, 2012). For a contract to be considered to be legally binding it must be supported by a valuable consideration. For instance, a party is required to do something in exchange for the promise that was made in a benefit of value. It is what each individual in the contact provides to the other as the established value for the others promise. For the most part, considerations are usually a payment of money, but are not always. At times they can be a promise to do something such as a type of work in return for something. The fourth element is legality. This is an agreement may be considered illegal if it would violate a statute result in commission of a tort or violate public policy. (Rogers, 2012). In contract law, legality of purpose is required of every enforceable contract. Agreement of a social nature are presumed not to be legally binding, but with evidence can be rebutted in court. Also, any domestic agreements such as agreements created by a parent and a child are generally unenforceable on the basis of the system of law.The last element is capacity. Capacity is the mental competency of an individual and also with special rules for people who are under legal age (Rogers, 2012). In other words, it deals with the competence of all parties. In order for an individual to enter into a contract they must be capable to do so. All parties entering the contract have to be over the legal age, mentally capable and cannot be under the influence of drugs or alcohol. If a contract is made with an individual that is under the age of 18 or 21, depending on the jurisdiction, the contract is voidable, but is legal and enforceable until or unless the individual revokes it. In theeyes of the law, individuals under the age of 18 or 21 are deemed to be immature and nave to enter into a contract. The individual may avoid the legal duty to perform the terms of the agreement without being liable of breach of contract. All parties must also be mentally capable of entering into a contract. If a party does not understand the nature and/or consequences of the contract when it is formed the contract can be voided. An individual that lacks the legal capacity can be declared incompetent in a court and can be appointed a legal guardian. If someone is to enter into a contract with someone who is not mentally capable the contract will be voided and there will not be any legal effects because neither party may be legally compelled to comply with the terms. Lastly, no one entering in to a contract can be intoxicated. All parties must be sober at the time of entering a contract in order for the contract to be deemed enforceable. When someone is under the influence they are not capable of knowing what they are doing and why. They might also not comprehend the terms of the contract which makes it unenforceable.A contact can appear to be legally binding because it may contain all the elements of a contract, but there are defenses to a contract that can also make a contract unenforceable and voidable. There are two types of defense to a contract, which are lack of genuine bow and lack of proper form. Genuine assent or meeting on the minds is a criteria utilized to determine validity of acceptance of an offer for a contract. This occurs when the acceptance of a contract is secured through improper or illegal means such as dodge, mistake, duress and undue influence. The first type of genuine assent that will be discussed is dodge. Fraud is the premeditated falsification of an essential matter of the contract. When there is an existence of fraud in a contractual proceeding it makes the contract unenforceable and can be voided by the party upon whom the deception was perpetrated.According to our text, there are two types of fraud, which are fraud in the execution and fraud in the inducement. Fraud in the execution merely occurs when one of the individuals who entered in to the contract isnt aware that they are entering in to one. The second fraud is when both parties are aware they are entering into the contract, but one of theparties is deceived when entering into it. The following type that can make a contract unenforceable and invalid is a mistake. A mistake is also known as a mutual mistake. When there is a mistake this means that both parties made a mistake to something that is vital to the contract. Just because one party can make a mistake doesnt necessarily mean that the contract is voidable. In order for it to be considered as unenforceable it must have a significant effect on the exchange or b argaining development. The following federal agent is duress. Duress is when one party forces the other party to sign a contract. The force can be either physical or emotional pressure. When there is use of duress the contract is voidable by the party that was under duress during sign. Duress can be defined by three categories, which are actual or threatened violence to an individual, threats to an individuals property and/or economic duress. Economic duress is the more difficult to prove because you have to establish the boundaries of acceptance behavior of this kind of pressure. Duress is sometimes compared to undue influence, but there are different. As mentioned above, duress deals with someone being pressured into signing the contract, whereas undue influence is when a party is manipulated in to signing the contract. If one party has put inequitable and inappropriate pressure on the other in the discussions leading to the signing of the contract, common law will allow duress an d undue influence to allow for the terms of the contract to be set aside. park laws are laws made by the decisions of judges in individual cases. (Rogers, 2012). Undue influence is easy to recognize because it can involve the parties having a fiduciary relationship or one of the members involved depends on another due to their age, illness, infirmity, etc. A fiduciary relationship is a relationship where one individual has a responsibility to act for the others benefit. When undue influence occurs the individual who is suppose to be helping the other person out is taking advantage of that person.Lastly, the second type of defense to a contract as listed above is lacks proper form. This is generally when it lacks writing. There are certain types of contracts that are required to be in writing, but at times we arent aware. If these types of contracts are not in writing then theycannot be enforced. It is important to learn about contract laws. They are the seat of our society. Since we enter into contracts on a daily bases we should be aware of these laws. Contracts can be complicated and having knowledge of the different types and what makes them enforceable or voided can genuinely be helpful. If there were no laws on contract then the agreements we make could become impractical and unworkable.ReferencesLewinsohn, J. L. (1914). Contract Distinguished From Quasi Contract. Fundamental Assumptions Of The Human Nature Politics Essay

Fundamental Assumptions Of The Human Nature Politics EssayThe fundamental assumptions about kind-hearted nature stand played a major role in determining the philosophy of life for many people. In fact, the manner in which various societies are organized politicall(a)y, socially as well as economically has a great dependence on basic assumptions on human nature. There are divers(prenominal) theories on how societies are organized based on assumptions towards human nature. Actually, all these theories are composed of assumptions on the preferences of human beings. There are various complex problems facing the modern world and whose solutions solely reside in the assumptions that are made by policy makers concerning human nature. The assumptions on human nature have elicited divers(a) reactions and escorts from assorted people (Rifkin 2009). As such, people have had varied preferences on the best and acceptable form of organization for their societies. The world leaders apply incompatible forms of governance depending on the assumptions they hold towards human nature.Governance based on human nature assumptions is an ancient principle spanning over 200 years ago. As a matter of fact, assumptions on human behavior can be traced to the enlightenment period (Turner 2006). This is the cartridge clip when the concept of modern market was born and to a fault the emergence of a posit era nation. During the period of enlightenment, various thinkers such as the John Locke, Marquis de Condorcet, Adam Smith and other philosophers had their indignation on the views expressed by the Christian faith of the medieval period that human nature was depraved and fallen. Similarly, the same faith viewed humans as seeking the pity of God for salvation in the world to come. Consequently, these philosophers sought to believe that human nature contained autonomy, rationality, as well as utilitarianism. Moreover, they proposed that human nature obtained salvation in the materi al acquisition obtained during their lifetime. The enlightenment thought pattern has had immense impacts on peoples perception of human nature and their preferred nation-state. The main focus of the nation state is the protection of property as well as the maintenance of citizen interests in all endeavors. Based on assumptions on the autonomy of human beings, nation states have been created. Thus the motivating for material acquisition and attainment of salvation to human nature has brought about the perpetuation of economic activities (Rifkin 2009). For instance, most of the modern nations embrace the view of human autonomy and search for individual growth. On the other hand, assumptions that human nature is dependent on the supernatural beings may bring about a form of governance that vests powers and privileges on a chosen intermediary. Such governments include the all-powerful monarchies which represent the divine will in governance.Positive assumptions on human nature can promo te effective governance. The modern society regards individual success and advancement with high esteem. Such assumptions make it justifiable for self governance (Turner 2006). The government is therefore justified to maintain the rules and regulations aimed at maintaining the agreed order. In spite of the shortcomings found in any form of governance, remarkable improvements can be done by embracing proper and correct assumptions on human nature. Additionally, immense success in governance can be attained done the embrace of new generation style of leadership. For instance, with the increased internal interrelationships, it is imperative for the government to take into account the biosphere politics which is a collaborative execution of nations, regions as well as localities all embedded by similar governance and demands.Essay no.3The federal official government has the overall power and authority over all agencies. In fact, the federal government mandates the state offices to per form specific tasks in accordance to the requirements of their formation and governance. On their own, the federal agencies may not perform effectively. They understand all authority and power from the underlying Acts that led to their formation and governance. Most importantly, there are essential requirements for the operation of the state agencies within such Acts (Ducat 2008). Therefore, the effect to which the federal agencies act and make rules and regulations is dependent upon the efficaciousity of the mandate by the federal government. The Supreme Court is mandated by the constitution to oversee all the legal activities of the federal government alongside the different federal agencies. As such, the regulations and rules applied by the agencies need to obtain approval of the Supreme Court. Moreover, there cannot be rules and regulations on how national agencies are to be rum without a nod from the Supreme Court (Ducat 2008). The entire process is supposed to be carried out through hearing with the federal constitutional requirements. The federal agencies are regarded as being independent regulatory offices. The functioning of the various Federal agencies and offices is facilitated by the congressional financial appropriation towards such agencies. Consequently, the relevance of the rules and regulations made by these agencies has to be determined by the congressional as well as constitutional requirements. The enforcement of the rules and regulations made by the Federal agencies in the Courts as laws has to dependent solely on the requirements of the Constitution (United States Office of Education 2010). For instance, an agency such as the Federal Communications commission was organize by the Communications Act of 1934 and it enjoys its independence based on the Federal constitutional requirements. Moreover, the agency boasts of immense power and authority to make rules and regulations within its constitutional requirements. The powers and resp onsibilities of the commissioners mandated to govern these Agencies are clearly enumerated in the Acts. For example in the case of the FCC, there are various titles of the 1934 Act on its formation that enlist different requirements of the agency. In fact, the first Title gives the description of the administration, formation as well as powers of the FCC. The Act also clarifies the process of selection and hiring of the commissioners charged with the responsibility of manning the Commission (United States Office of Education 2010).The applicability and constitutionality of the rules and regulations made by Federal agencies and offices into laws in the courts depends on the Act on their formation. For example, the Acts tend to give a general functioning of the Agencies and their formation. However, there are specific issues that are left for the agencies to accomplish. Therefore, when the agencies narrow down the requirements of their formation, they are required to come up with rule s and regulations on their functioning (Ducat 2008). Such rules and regulations need to be recognized by the courts. Nevertheless, the courts may fail to recognize such rules and regulations as laws under some conditions such as violation of certain federal laws or when the agencies act beyond their constitutional requirements.Section B essay no. 1The debate on human nature and governance has had diverse discussions and propositions from several philosophers. For instance, philosophers such as John Locke and Friedrich Nietzsche have had diverse ideas and focus towards human nature (Andrew 1999). The two philosophers have delved in various areas of interest depending on the circumstances during their time and the preferences of their studies. Nevertheless, there are pertinent issues that tend to classify their works based on human nature. Moreover, these philosophers were interested in understanding the work of the society with man as the main center of focus. From the perspective pr esented by John Locke, there are various factors that make human beings equal irrespective of the circumstances that entangle them. According to John Locke, there are various factors that bring about differences in views on religion and other issues in life. However, it is decisive that the differences are addressed in such a way as to promote better and harmonious relations among all men (Rifkin 2009). Furthermore, John Locke admits the existence of diversified views about religion and ways of life with each type claiming originality and superiority of beliefs. However, John Locke defends the importance of embracing tolerance towards the diversified views. Similarly, Locke proposed the importance of evasion the transmission of personal views and beliefs by elected representatives and embracing independence. Thus for him, human equity need to be the guiding principle for the maintenance of a complaisant society that enables human beings to thrive on individual basis. On the contr ary, Friedrich Nietzsches perception of human beings on inequality is based on his immediate circumstances and beliefs. In fact, the views presented by Nietzsche about human beings leaves a lot to be desired. For instance, the claim that illusion tend to satisfy human intellect in most of the time shows how diabolical his views are. Similarly, Nietzsche dismisses the existence of rationality among men as the guide into truth (Andrew 1999). Surprisingly, he makes a proposition that deception forms the basis of human beliefs. The harsh creation of human nature by Nietzsche does not reveal the true nature of man. For instance, the claims in Nietzsches perspective seem distorted and presenting a negative view on life in general and human beings in particular. On the other hand, Lockes views tend to place major importance on human capability and potency of self-determination. Lockes perspective presents a true account of man and his pursuit of better end.
